RELATING TO ADULT GUARDIANSHIP AND PROTECTIVE PROCEEDINGS JURISDICTION. Adopts the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act, to ensure that only one state has jurisdiction at any one time. Contains specific guidelines to specify which court has jurisdiction to appoint a guardian or conservator for an incapacitated adult. Prioritizes the states that may claim jurisdiction. Effective 7/1/2014. (SD1)

RELATING TO TEMPORARY RESTRAINING ORDERS. Allows temporary restraining orders against harassment and domestic abuse to be issued upon the submission of oral sworn testimony or complaint to a judge by electronic measures. Effective 07/01/50. (SD1)

RELATING TO LIMITATION OF ACTIONS. Extends the statute of limitations for civil actions brought by persons subjected to sexual offenses as a minor against the person who committed the act. Revives for a two-year period certain actions for which the statute of limitations had previously lapsed. Authorizes a court to award attorney's fees to a defendant when a accusation of sexual abuse was made with no basis in fact and with malicious intent. (SD1)

RELATING TO CHILD PROTECTION. Establishes a preference for allowing an abused child, who has been removed from the family home, to return to the home, by placing the burden on the child's family to establish that it is in the child's best interest to remove the child from the home, rather than remove the alleged or potential perpetrator. RELATING TO MEDICAID. Amends sections 346-29.5(b) and 346-37(g), Hawaii Revised Statutes, to state that the department of human services shall submit a written notice of lien and an itemized list of payments so as to provide sufficient information regarding its payments to the person being sentenced. Considers the entire amount valid in determining the amount of restitution unless contested or unless a specific line item charge or charges in the lien are contested on a good faith basis. (SD1)

RELATING TO INSURER REQUIREMENTS. Requires all commercial health care insurers operating in Hawaii to share with the department of human services, a listing of their members for medicaid eligibility determination. (SD1)

RELATING TO EXEMPTIONS FROM CHILD CARE LICENSING. Adds exemptions for any kindergarten, school, or program licensed by the charter school review panel, the Hawaii Council of Private Schools, or any federal agency and certain child care programs conducted by the counties from child care licensing by the department of human services. Effective July 1, 2013. (SD1)

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES AUTHORIZED BY THE DEPARTMENT OF HUMAN SERVICES. Amends the definition of "employment" in sections 386-1, 392-5, and 303-5, HRS, to exempt aged and disabled recipients of home and community-based services authorized by the Department of Human Services and recipients of state-funded home and community-based services from having to provide workers' compensation, temporary disability insurance, and prepaid health care. Effective 07/01/50. (SD1)

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES FOR PERSONS WITH DEVELOPMENTAL AND INTELLECUTAL DISABILITIES. Amends the definition of "employment" in various sections of the Hawaii Revised Statutes by clarifying the "domestic services" exclusion for services to persons with developmental and intellectual disabilities. RELATING TO APPROPRIATIONS FOR THE HONOLULU FAMILY JUSTICE CENTER. Appropriates funds to the department of the prosecuting attorney of the city and county of Honolulu for the Honolulu family justice center. (SD2)

RELATING TO FAMILY COURT. Allows impoverished family court plaintiffs and petitioners to serve notice by posting pleadings at the courthouse in lieu of notice by publication, subject to order of the court, demonstration of a diligent search, and mailing of the pleadings to the defendant's or respondent's closest known relative.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: Five copies (including an original) to Room 323 in the State Capitol;
FAX: For comments less than 5 pages in length, transmit to 586-6051 (for Oahu) or 1-800-535-3859 (for Neighbor Islanders without a computer to submit testimony through e-mail or the Web);
EMAIL: For comments less than 5 pages in length, transmit to HUStestimony@Capitol.hawaii.gov ; or
WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
