RELATING TO CHILD SUPPORT ENFORCEMENT. Establishes that every judgment for child support is enforceable until paid in full.

RELATING TO ADULT GUARDIANSHIP AND PROTECTIVE PROCEEDINGS JURISDICTION. Adopts the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act, to ensure that only one state has jurisdiction at any one time. Contains specific guidelines to specify which court has jurisdiction to appoint a guardian or conservator for an incapacitated adult. Prioritizes the states that may claim jurisdiction.

RELATING TO TEMPORARY ASSISTANCE FOR OTHER NEEDY FAMILIES. Requires that applicants for Temporary Assistance for Other Needy Families benefits reside in the State for at least six consecutive months immediately preceding their application to receive such benefits.

RELATING TO CHILD VISITATION. Permits family court to award reasonable visitation to grandparents if the denial of visitation would cause significant harm to the child. Establishes a rebuttable presumption that visitation decisions made by a parent are in the best interests of the child. Presumption may be rebutted by certain evidence. Identifies factors the court shall consider in awarding visitation. Effective July 1, 2012.

RELATING TO MEDICAID. Establishes a formula for calculating the amount to be contributed by the State, towards a claimant's attorney's fees and costs, in lieu of recovering the full amount as stated in section 346-37(f) and (h), Hawaii Revised Statutes.

RELATING TO INSURER REQUIREMENTS. Requires all commercial health care insurers operating in Hawaii to share with the Department of Human Services, a listing of their members for medicaid eligibility determination.

RELATING TO EXEMPTIONS FROM CHILD CARE LICENSING. Adds exemptions for any kindergarten, school, or program licensed by the Charter School Review Panel, the Hawaii Council of Private Schools, or any federal agency from child care licensing by the Department of Human Services.

RELATING TO ADULT ABUSE PREPETRATOR CHECKS FOR CHILD CARE PROVIDERS. Allows the Department of Human Services to conduct adult abuse perpetrator checks on providers, license exempt pursuant to section 346-152, Hawaii Revised Statutes, who care for children receiving child care subsidies from the department, applicants who want to operate a child care facility, prospective employees of the applicant, licensed child care providers, and new employees of the registered or licensed provider.

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES AUTHORIZED BY THE DEPARTMENT OF HUMAN SERVICES. Amends the definition of "employment" in the workers' compensation, temporary disability insurance, and prepaid health care statutes by clarifying the "domestic services" exclusion for services authorized by the Department of Human Services.

RELATING TO MORTALITY REVIEW FOR PERSONS WITH DEVELOPMENTAL OR INTELLECTUAL DISABILITIES. Creates a new part in chapter 321, Hawaii Revised Statutes, giving the Department of Health the authority to obtain all records for death review for persons with developmental or intellectual disabilities.

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES FOR PERSONS WITH DEVELOPMENTAL AND INTELLECTUAL DISABILITIES. Amends the definition of "employment" in various sections of the Hawaii Revised Statutes by clarifying the "domestic services" exclusion for services to persons with developmental and intellectual disabilities.

RELATING TO CHILD CUSTODY. For determinations of parental visitation rights, establishes a rebuttable presumption that the custodial parent's decision regarding visitation is in the best interests of the child. Requires the court to consider various factors in awarding parental visitation rights.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:
PAPER: Five copies (including an original) to Room 323 in the State Capitol;
FAX: For comments less than 5 pages in length, transmit to 586-6051 (for Oahu) or 1-800-535-3859 (for Neighbor Islanders without a computer to submit testimony through e-mail or the Web);

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
