Prohibits an insurer from requiring a doctor's referral for annual covered mammograms.

RELATING TO PRIVACY OF HEALTH CARE INFORMATION.

Provides that use, disclosure, or authorization for release of individually identifiable health information that complies with federal law shall be deemed to comply with state law.  Provides that notice of breach of unsecured protected health information that complies with federal law shall be deemed to comply with state law.

      Status & Testimony

RELATING TO HEALTH.

Requires the director of health to convene a mental health and substance abuse parity working group to determine how the State can come into compliance with federal mental health and substance abuse parity laws and regulations and enhance existing state parity laws.

RELATING TO HEALTH.

Requires health insurers to provide outpatient prescription drug coverage.  Prohibits health insurers from requiring coinsurance as a basis for cost sharing with the insured for outpatient prescription drug benefits.  Limits the amount of copayments an insured must pay for prescription drugs.

MAKING AN APPROPRIATION FOR THE VECTOR CONTROL BRANCH.

Makes appropriation to restore the vector control branch of the DOH to fiscal year 2007-2008 funding levels.  Effective 7/01/12.

RELATING TO MENTAL HEALTH.

Amends various provisions relating to emergency examination and hospitalization and involuntary treatment.  Broadens the definitions of "dangerous to others" and "dangerous to self" to include a substantial likelihood of harm in the reasonably foreseeable future, and amends the definition of "gravely disabled".

Makes an appropriation for the Hawaii health authority.

RELATING TO THE ISSUANCE OF SPECIAL PURPOSE REVENUE BONDS TO ASSIST NOT-FOR-PROFIT CORPORATIONS THAT PROVIDE HEALTH CARE FACILITIES TO THE GENERAL PUBLIC.

Extends the lapse date of the special purpose revenue bonds authorized to assist The Queen's Health Systems in Act 176, Session Laws of Hawaii 2003, and as amended by Act 86, Session Laws of Hawaii 2007.

MAKING AN APPROPRIATION FOR EMERGENCY MEDICAL SERVICES.

Appropriates $1,500,000 for fiscal year 2012-2013 for emergency medical services in the west Oahu region.

Establishes the Hawaii colorectal cancer screening program to assist individuals with the detection and care of colorectal cancer.  Appropriates funds for the program.

RELATING TO TOBACCO.

Requires cigarettes and tobacco products to be stored for sale behind a counter.  Requires advertisements that promote or encourage the purchase or use of cigarettes or tobacco products to be placed twenty-five feet away from children's products, toys, cookies, candy, ice cream, gum, or snacks.  Requires advertisements that promote or encourage the purchase or use of cigarettes or tobacco products to be placed four feet off the floor.  Permits exceptions for retail tobacco stores, bars, or establishments where the minimum age for admission is eighteen.
