RELATING TO FIRE SPRINKLERS.

Prohibits counties from requiring installation or retrofitting of automatic fire sprinklers in new or existing one- or two‑family dwelling units used only for residential purposes.

RELATING TO PUBLIC HOUSING.

Requires the HPHA to adopt rules to implement a five-year time limit for any tenant's use and occupation of any dwelling unit or other premises located within a state public housing project.

RELATING TO PUBLIC HOUSING.

Authorizes the Board of Directors of the Hawaii Public Housing Authority to set the executive director's compensation based on a comparability analysis and other factors.

RELATING TO EMERGENCY SHELTERS.

Requires a county that is relocating a homeless person or family from public property, to provide access to a temporary emergency shelter and notify the person or family of the location of the emergency shelter.

RELATING TO CAPITAL IMPROVEMENT PROJECTS.

Exempts temporarily from the state and county civil service:  (1) persons hired or contracted to repair and maintain vacant state or county housing units; and (2) persons hired or contracted to perform planning, design, engineering, or permit processing work for state or county capital improvement projects.  Makes an appropriation out of general obligation bonds and the rental housing trust fund to the Hawaii public housing authority for the purpose of renovating uninhabitable public housing units.

Status

RELATING TO INSURANCE.

Requires the Insurance Commissioner to publish listing of homeowners insurers and homeowners insurance premium rates in a newspaper of general circulation in the State annually; and allows the Insurance Commissioner to specify interim rates upon disapproval of insurance rate filings for property and casualty insurance.

RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Exempts certain private dorm management companies that provide housing to students of private universities or other higher education institutions from the residential landlord-tenant code.

Status

RELATING TO PUBLIC HOUSING.

Prohibits smoking in federal and state low-income housing projects.  Establishes a $100 fine for each violation of the smoking prohibition.  Specifies that a third violation of the smoking prohibition by a tenant, licensee, or occupant of the housing project shall result in eviction.  Creates separate accounts under the public housing revolving fund and state low-income revolving fund, into which fines from public housing smoking violations are to be deposited.  Effective July 1, 2012.

Status

RELATING TO HOMEOWNERSHIP.

Establishes the Homeownership Initiative Pilot Program which allows eligible employees to withdraw funds from their employees' retirement system accounts, to be used exclusively for a down payment on a qualifying multifamily residential property that will be used as a primary residence.

Status

RELATING TO ACCESS TO REAL PROPERTY.

Requires a seller to disclose in writing to a buyer the existence, if any, of legal or traditional public access that burdens the residential or agricultural real property being sold.  Effective July 1, 2011.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

WEB:      For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
