RELATING TO THE DEFINITION OF AGGRAVATED CIRCUMSTANCES IN THE CHILD PROTECTIVE ACT.

Ensures that the definition of "aggravated circumstances" in chapter 587A, Hawaii Revised Statutes, is consistent with recent changes to the federal Child Abuse Prevention and Treatment Act provisions.

RELATING TO ADULT ABUSE PERPETRATOR CHECKS FOR CHILD CARE PROVIDERS.

Allows the Department of Human Services to conduct adult abuse perpetrator checks on providers, license exempt pursuant to section 346-152, Hawaii Revised Statutes, who care for children receiving child care subsidies from the department, applicants who want to operate a child care facility, prospective employees of the applicant, licensed child care providers, and new employees of the registered or licensed provider.

Allows the Department of Human Services to charge reasonable fees to obtain a child care license or certificate of registration and establishes a special fund.

RELATING TO CONTRACT PROPOSALS FOR CHILD CARE.

Allows an exception to allow for proposals to be received from organizations that are not yet licensed to operate a child care program at a facility specified in the request for proposals.

      Status & Testimony

RELATING TO OFFENSES AGAINST THE PERSON.

Creates an offense of excessive discipline of a minor by using certain disciplinary actions against a minor under the age of eighteen years.  Makes it punishable by a first, second, or third degree assault, depending on severity of injury to the minor.  Effective 1/1/2013.

RELATING TO CHILDREN.

Requires a parent, guardian, or other person having the care, custody, or control of a child to report the death of a child or location of the corpse of a child to law enforcement as soon as is reasonably possible after learning of the death or location of the corpse; requires a parent, guardian, or other person to report a missing child to law enforcement as soon as is reasonably possible after the parent, guardian, or other person obtains knowledge that the child is missing; establishes a class C felony offense for reporting violations and for giving false information to law enforcement authorities conducting a missing person investigation or a felony criminal investigation involving a child.

RELATING TO MANDATORY REPORTING REQUIREMENTS.

Amends the definition of child abuse or neglect to include acts or omissions of any person or legal entity.  Requires mandatory reporting when there is reasonable suspicion of child abuse or neglect.  Expands medical personnel's duty to report wounds to include injuries suffered by a victim of labor trafficking or injuries that result from prostitution.  Subjects a person who reports wounds to physician-patient privilege regarding patient communications for the diagnosis or treatment of the patient but not regarding physician's observations of patient.

RELATING TO FOSTER YOUTH.

Requires the department of human services to automatically enroll former foster youth in an appropriate medical assistance program and automatically re-enroll former foster youth until they reach age twenty-six.

RELATING TO CHILDREN AND YOUTH.

Requires public events celebrating Children and Youth Day to be held on state capitol grounds on the first Sunday in October if the Children and Youth Day planning committee so chooses, unless otherwise determined by the governor.

RELATING TO UNIVERSAL CHILDREN'S SAVINGS ACCOUNTS.

Creates a universal children's savings account program under the department of budget and finance.

RELATING TO EARLY INTERVENTION SERVICES.

Requires the department of health to develop and establish a family cost participation schedule of monthly cost participation fees for early intervention services.  Authorizes the department to offer early intervention services on a fee-for-service basis for children who are ineligible for services under part C of the Individuals with Disabilities Education Act.

MAKING AN APPROPRIATION FOR YOUTH SERVICES.

Appropriates funds as a grant to the Kalihi YMCA, Parents and Children Together, and Susannah Wesley Community Center to support youth services.

RELATING TO INSURANCE.

Specifies that group health insurance plans shall provide dependent coverage for natural grandchildren adopted by plan participants or beneficiaries.

RELATING TO CHILD CUSTODY.

For determinations of parental visitation rights, establishes a rebuttable presumption that the custodial parent's decision regarding visitation is in the best interests of the child.  Requires the court to consider various factors in awarding parental visitation rights.
