Specifies that the Hawaii health connector shall establish and administer one separate program to serve the individual market and one separate program to serve the small group market. Establishes staggered terms for board members. Clarifies qualifications of and restrictions on navigators. Clarifies role of the department of human services in determining medicaid eligibility. Makes permanent the general excise tax exemption on amounts received by a managed care support contractor of the TRICARE program for the actual cost or advancement to third party health care providers pursuant to a contract with the United States. RELATING TO THE HAWAII IMMUNIZATION REGISTRY. Authorizes the department of health to allow limited health insurer access to the Hawaii immunization registry and authorizes the Hawaii immunization registry to store minimal demographic information for individuals who have elected to refuse inclusion in the Hawaii immunization registry. Effective 07/01/50. (SD1)

RELATING TO PSEUDOEPHEDRINE. Establishes an electronic tracking system for the sale of products containing pseudoephedrine base beginning 1/1/13. Requires the department of public safety narcotics enforcement division to implement the electronic tracking system in conjunction with the existing narcotics tracking system no later than 1/1/15. RELATING TO PRESCRIPTION DRUG. Requires the director of human services to develop a uniform prescription drug prior authorization form no later than 07/01/2013. Beginning 01/01/2014, requires the uniform prescription drug prior authorization form to be used by prescribers and health care insurance providers. Effective 7/1/50. (SD1)

RELATING TO THE CENTER FOR NURSING. Makes permanent the assessment and deposit of center for nursing fees into the compliance resolution fund and distribution of those funds to the credit of the center for nursing special fund.

RELATING TO TATTOO ARTISTS. Restricts the sale of tattoo supplies. Requires blood borne pathogen test as a prerequisite for licensure beginning 1/1/2013 and every four years after initial test to continue to hold a license. Prohibits tattoo trade shows. Prohibits body piercing or body modifications at product demonstrations or educational demonstrations. Creates a tattoo artist task force. Reports to legislature. Effective 07/01/2050. (SD2)

RELATING TO THE DEPOSIT BEVERAGE CONTAINER PROGRAM. Removes the exemption for dietary supplements from the deposit beverage container program.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
