RELATING TO THE TRICARE PROGRAM.

Excludes from the general excise tax, amounts received by a managed care support contractor of the TRICARE program for the actual cost or advancement to third party health care providers pursuant to a contract with the United States.  Effective

Status

RELATING TO PRESCRIPTION DRUG.

Requires the insurance commissioner to develop a uniform prescription drug prior authorization form no later than 07/01/2013.  Beginning 01/01/2014, requires the uniform prescription drug prior authorization form to be used by prescribers and health care insurance providers.

HB 2114

Status

RELATING TO THE HAWAII HEALTH INSURANCE EXCHANGE.

Provides a definition of consumer in the chapter on Health Insurance Exchange, requires statewide representation on the Health Insurance Exchange Board, removes insurers from serving on the Health Insurance Exchange Board, clarifies that representation by providers is not limited to dental providers, and requires the Hawaii Health Insurance Exchange to offer a basic health plan.  Effective July 1, 2012.

Allows the Department of Health to share records with other state departments and agencies upon authorization of a person with a tangible interest in the record.

RELATING TO HEALTH CARE INFORMATION.

Clarifies that persons and entities governed by the Health Insurance Portability and Accountability Act, who use or disclose individually identifiable health information that is consistent with the Health Insurance Portability and Accountability Act regulations, shall be deemed to be in compliance with Hawaii's privacy laws and rules.

RELATING TO MENTAL HEALTH.

Authorizes the emergency examination of a patient by telemedicine for the purposes of emergency hospitalization in a psychiatric facility.

RELATING TO INVOLUNTARY PSYCHIATRIC HOSPITALIZATION.

Establishes new procedures for the examination and involuntary hospitalization of persons that meet criteria for commitment to psychiatric facilities.

RELATING TO MILK.

Allows milk produced by a hoofed animal to not be pasteurized if it is intended for personal consumption or personal use by any person, including a milk producer.

RELATING TO MEDICAL CLAIM CONCILIATION.

Makes numerous amendments to part II of chapter 671, HRS, to make the medical claims conciliation process less adversarial and to emphasize inquiry, conciliation, and settlement.  Renames the panels as medical inquiry and conciliation panels.

Status

RELATING TO ASSAULTS AGAINST MEDICAL SERVICES PROVIDERS.

Expands the offense of assault in the second degree to include harm to any medical service providers engaged in the performance of duty.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

 

Submit testimony in ONE of the following ways:

FAX:       For comments less than 5 pages in length, transmit to 586-6281(for Oahu) or 1-800-535-3859 (for Neighbor Islanders without a computer to submit testimony through e-mail or the Web);

EMAIL:  For comments less than 5 pages in length, transmit to HLTtestimony@Capitol.hawaii.gov ; or

WEB:      For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes.  This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
