RELATING TO VACANCIES.

Amends the deadline to file nomination papers associated with filling a vacancy in the membership of the board of trustees of OHA, to ensure compliance with provisions of the National Defense Authorization Act for Fiscal Year 2010, P.L. 111-84, mandating the mailing of absentee ballots to uniformed and overseas voters no later than forty-five days prior to an election.

RELATING TO THE OFFICE OF HAWAIIAN AFFAIRS.

Requires OHA to establish 1 full-time equivalent permanent position for a genealogies manager.  Appropriation.

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Requires 5% of the State's annual share of the revenues from the public land trust to be annually appropriated to DHHL.

RELATING TO GAMING.

Authorizes the Hawaiian homes commission to allow gaming on Hawaiian home lands and to consult with the Hawaiian Homes Commission Act, 1920 beneficiaries and designate specific Hawaiian home lands parcels for the purposes of establishing gaming operations.  Creates the Hawaii gaming commission to regulate gaming operations.  Imposes a wagering tax on gross receipts of gaming operations and provides for distribution to the general fund and Hawaiian home lands trust fund.

RELATING TO THE DEPARTMENT OF HAWAIIAN HOME LANDS.

Extends the repeal date in Act 187, Session Laws of Hawaii 2010, to continue the pilot program that enables the Department of Hawaiian Home Lands to begin housing and other projects without having the full amount of the cost of the projects on hand at the start of the project.

Exempts expenditures less than $250,000 from trust funds identified in section 213(d), Hawaiian Homes Commission Act, 1920, as amended, from the requirements of chapter 103D, Hawaii Revised Statutes.

RELATING TO RENEWABLE ENERGY REVENUE.

Identifies geothermal royalties and revenue from public land dispositions to renewable energy producers as supplemental sources of revenue for the Native Hawaiian Rehabilitation Fund.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Allows the chairman, with unanimous consent of the commission, to suspend administrative rules for the purpose of awarding a lease to a native Hawaiian who has been on the waitlist for at least twenty years.

RELATING TO A DISCOUNT AND SAVINGS PROGRAM.

Establishes a discount and savings program to generate revenue for the Department of Hawaiian Home Lands for the purpose of maintaining its trust lands and communities, and educating participants about the state’s lands and natural resources.

Status

RELATING TO THE OVERTHROW OF THE HAWAIIAN KINGDOM.

Establishes a commission within the Office of Hawaiian Affairs to recognize and commemorate the native Hawaiians who signed the Petition Against Annexation.  Specifies that funding for the operations of the petition against annexation memorial commission shall be provided by the office of Hawaiian affairs.  Effective July 1, 2012.

RELATING TO EDUCATION.

Appropriates funds for three permanent positions and operating expenses for Ho‘okulaiwi: ‘Aha Ho‘ona‘auao ‘Oiwi (the center for Native Hawaiian and indigenous education) within the University of Hawaii at Manoa.

Status

RELATING TO THE NATIVE HAWAIIAN ORGANIZATION NOTIFICATION LIST.

Requires the office of Hawaiian affairs to make accessible a copy of the federal Native Hawaiian Organization Notification List so that it may serve as a resource by which state agencies and other interested parties may direct information dissemination and address topics including kuleana lands and curatorship.
