RELATING TO HIGH TECHNOLOGY. Defines qualified high technology business. Adds reporting requirements. Establishes a fine for failure to file the survey information in the reporting requirements. Extends the tax credit through 2016. Applies to tax years beginning after 12/31/2011. Authorizes aerospace high technology parks as a permitted use within certain agricultural districts. Requires parks to obtain a special permit. Requires the University of Hawaii to extend the current land lease with the high technology development corporation. Effective July 1, 2112.

RELATING TO PROCUREMENT. Imposes time limits on administrative and judicial review decisions. Limits protests to those that are a minimum percentage of the contract value. Temporarily authorizes the governor or a county mayor to exempt a procurement from protest. Makes permanent the amendments made to section 103D-305, Hawaii Revised Statutes that increase the limits on procurements qualifying for certain small purchase procedures. Effective July 1, 2112.

RELATING TO SPECIAL MANAGEMENT AREAS. Clarifies definition of "development" for purposes of special management area permitting by counties.

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Authorizes an agency or an applicant to bypass the preparation of an environmental assessment and proceed directly with an environmental impact statement for proposed actions that are determined to require an environmental impact statement.

RELATING TO RECYCLING. Creates the Hawaii electric device recycling task force to make recommendations for a workable recycling program for electric devices and household batteries. Requires report to the Legislature. Dissolves task force on June 30, 2013.

RELATING TO ELECTRIC UTILITIES. Authorizes the Public Utilities Commission to allow electric utility companies to recover all power purchase costs that have been approved by the Commission.

RELATING TO GEOTHERMAL RESOURCES. Differentiates between "geothermal resources exploration" and "geothermal resources development". Designates "geothermal resources exploration" and "geothermal resources development" as permissible uses in all state land use districts and conservation district zones. Repeals geothermal resource subzone provisions under state land use law.

RELATING TO ENERGY. Authorizes the Public Utilities Commission (PUC) to establish a grid reliability rate surcharge to electric utility companies to encourage the negotiation of new or existing power purchase agreements with renewable energy producers that contain an avoided cost rate and generally eliminate curtailment. Authorizes the PUC to provide a higher rate of return to an electric utility company for capital investments made to support the integration of new renewable energy based power generation facilities.

RELATING TO RENEWABLE ENERGY. Allows the public utilities commission to direct electric utilities to include specific scenarios and resource options as part of their integrated resource plans, to develop a framework to replace oil-based power generation facilities, and to examine certain policies related to the distribution of renewable energy. Effective July 1, 3000.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
