RELATING TO PUBLIC SCHOOL FACILITIES. Establishes the school facilities special fund. Requires that income generated by the Public Land Development Corporation from public school lands and facilities be deposited into the school facilities special fund for the purposes of new construction, upgrades, and retrofit and upgrade of public school facilities. Includes a reporting requirement. Effective July 1, 2050.

RELATING TO LEGACY LANDS. Requires nonprofit land conservation organizations to provide, in addition to a conservation easement, a deed restriction or covenant, as a condition to the receipt of funds under the legacy land program. Requires the board of land and natural resources to be made a full or partial owner of any conservation provided by a state or county agency or nonprofit land conservation organization as a condition for receipt of funding under the legacy lands program. Allows for the exemption of the easement requirements by the board. Requires applicants for legacy land funds to submit the project's public benefit and to consult with the staff of the department of land and natural resources, the department of agriculture, the agribusiness development corporation, and the public land development corporation.

RELATING TO AQUATIC LIFE. Requires monitoring and reporting on the two existing marine life conservation districts on Maui. Establishes statutorily the division of aquatic resources under the department of land and natural resources. Effective July 1, 2050.

RELATING TO COMMUNITY PLANNING. Establishes planning districts and creates a process for developers to apply for residential and commercial exceptional planning projects. Establishes the transit-oriented or main-street redevelopment program. Authorizes state and county incentives for exceptional planning projects. Establishes a discretionary review process for the transfer of floor area within the planning district. Effective July 1, 2050.

RELATING TO NATIVE HAWAIIANS. Establishes aha moku advisory committee within the Department of Land and Natural Resources. Makes an appropriation. Effective July 1, 2012.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
