RELATING TO GOVERNMENT PUBLICATIONS. Updates the existing chapter 93, Hawaii Revised Statutes, in response to changes in technology and reduces printing, workload, and delivery costs for all state and county agencies; requires the chief information officer, with the assistance of the office of information management and technology and the Hawaii state public library system, to review the technology, personnel, training, fiscal, and other requirements necessary to implement a program through which state and county agencies would make all of their publications available in electronic format for online distribution; requires report to 2013 legislature.

RELATING TO EDUCATION. Establishes the executive office on early learning. Establishes the early learning advisory board to replace the early learning council. Repeals junior kindergarten programs at the end of the 2013-2014 school year. Beginning with the 2014-2015 school year, requires students to be at least five years of age on July 31 of the school year in order to attend kindergarten. Effective July 1, 2012.

RELATING TO INSTRUCTIONAL TIME. Requires the Department of Education to develop multiple standard bell schedules for elementary, middle, and high schools, with the exception of charter schools and multi-track public schools. Amends the public education instructional time law.

RELATING TO EDUCATION. Requires teachers first entering Department of Education employment to serve a probationary period of three years prior to attaining tenure. Provides the Department the directive, means, and flexibility to establish a performance management system that includes an evaluation of teachers and educational officers. Effective July 1, 2050.

RELATING TO TAXATION. Prohibits penalties for substantial understatements or misstatements and for erroneous claims for refund or credit from being added to tax underpayments on which certain other penalties are already imposed. Unless preempted by federal law, requires the collection of use taxes by sellers of tangible personal property who enter into agreements under which a person in the State refers potential purchasers to the seller, including by an internet link or web site, or performs related services in the State on behalf of the seller. Effective July 1, 2112.

RELATING TO TAXATION. Establishes monetary awards for whistleblowers for a Department of Taxation administrative or judicial action. Authorizes the Director of Taxation to appoint an administrative appeals officer. Prohibits certain penalties from being added to tax underpayments on which certain other penalties are already imposed. Requires all advertisements and solicitations for transient accommodations to display the registration identification number or the website address containing the registration identification number. Effective July 1, 2112.

RELATING TO TAXATION. Prohibits penalties from being added to tax underpayments on which certain other penalties are already imposed. Establishes monetary awards for whistleblowers for a Department of Taxation action for violations of tax laws. Mandates that nonprofit organizations receive notice before denial of general excise tax benefit. Limits liability of persons having control of certain amounts held in trust for nonprofit organizations. Effective July 1, 2112.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
