MAKING AN APPROPRIATION FOR EARLY CHILDHOOD HEALTH. Establishes a childhood obesity prevention task force. Appropriates funds to the department of health to support early childhood development, including the collection of obesity data, childhood obesity awareness, and promotion of best practices to improve healthy life choices. Effective July 1, 2050.

RELATING TO FAMILY COURT. Allows impoverished family court plaintiffs and petitioners to serve notice by posting pleadings at the courthouse in lieu of notice by publication, subject to order of the court, demonstration of a diligent search, and mailing of the pleadings to the defendant or respondent, and to the defendant's or respondent's closest known relative. Effective September 1, 2012.

RELATING TO ADULT GUARDIANSHIP AND PROTECTIVE PROCEEDINGS JURISDICTION. Adopts the Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act to ensure that only one state has jurisdiction in guardianship and protective proceedings at any one time. Contains specific guidelines to determine jurisdiction. Effective July 1, 2014.

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES AUTHORIZED BY THE DEPARTMENT OF HUMAN SERVICES. Amends the definition of "employment" in sections 386-1, 392-5, and 303-5, HRS, to exempt aged and disabled recipients of home and community-based services authorized by the Department of Human Services and recipients of state-funded home and community-based services from having to provide workers' compensation, temporary disability insurance, and prepaid health care. Effective 07/01/50.

RELATING TO EMPLOYMENT EXEMPTION FOR DOMESTIC SERVICES FOR PERSONS WITH DEVELOPMENTAL AND INTELLECTUAL DISABILITIES. Amends the definition of "employment" in various sections of the Hawaii Revised Statutes by clarifying the "domestic services" exclusion for services to persons with developmental and intellectual disabilities.

RELATING TO PSYCHOTROPIC MEDICATIONS IN MEDICAID. Makes permanent previous changes to the psychotropic medication statute that ensure access to medically necessary psychotropic medications while allowing cost-effective strategies. Effective 1/1/50.

RELATING TO MEDICAID. Sets lien requirements for the liens for restitution from a third party. For community care foster family homes, temporarily delays loss of license upon departure of last Medicaid client and lowers substitute caregiver minimum age. Effective July 1, 2050.

RELATING TO MEDICAID. Defines "medical institution". Provides for the development of a fair and equitable reimbursement system for all clients under the Medicaid program for home- and community-based caregiver services and a fair and equitable referral system for clients transferring from hospitals to community based care homes. Effective July 1, 2050.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
