Status

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW.

Establishes the Boiler and Elevator Special Fund for the purpose of collecting and depositing fees charged for permits, inspections, and certificates of boilers, pressure systems, elevators, and kindred equipment, and amusement rides to provide sufficient operating funds for the Boiler and Elevator Inspection Branch.  Requires repayment of the start-up general revenues deposited into the special fund within five years.  Effective March 3, 2033.

RELATING TO EMPLOYMENT SECURITY LAW.

Amends the procedure for rate determination to clarify that the department's determination must be appealed to the referee and not directly to circuit court.  Effective July 1, 2112.

Status

RELATING TO COMPENSATION.

Stipulates that the five per cent decrease to the legislative, executive, and judicial salaries applies to what the respective salaries were as of June 30, 2009, and remains at the specified salary rate until June 30, 2013.  Repeals Act 85, Session Laws of Hawaii (SLH) 2009, as amended by Act 57, SLH 2011, as amended by this Act, at 11:59 p.m. on June 30, 2013.  Provides that the repeal of the aforementioned Acts for the period of July 1, 2009, through June 30, 2013, shall not be construed to restore or reinstate any leaves for vacation or sick leave, any salary, or any other compensation reduced by the Acts.  Effective upon its approval.

RELATING TO LABOR.

Directs the Department of Labor and Industrial Relations to establish a state-funded training program to expand the workforce investment activities administered by the DLIR under the federal Workforce Investment Act.  Makes an appropriation. Provides for the adoption of rules.  Effective July 1, 2012.

RELATING TO WORKERS' COMPENSATION.

Clarifies that attorney's fees may be included in costs that may be assessed against a party who brings, prosecutes, or defends a workers' compensation claim without reasonable ground.  Effective July 1, 2112.

RELATING TO NOTICE OF WORKERS' COMPENSATION INSURANCE.

Allows the Director of Labor and Industrial Relations to accept the notice of employer's workers' compensation insurance from approved third party agencies in a manner and form approved by the Director.  Effective July 1, 2112.

Status

RELATING TO WORKERS' COMPENSATION.

Increases the fee schedule of compensation for medical care, services, and supplies in workers' compensation cases from 110 percent to 130 percent of the Medicare Resource Based Relative Value Scale applicable to Hawaii as prepared by the United States Department of Health and Human Services.  Does not apply to motor vehicle insurance rates.  Effective July 1, 2112.

·     The Committee the comments are directed to;

·     Measure number; and

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
