RELATING TO THE CONVENTION CENTER. PROPOSED HD1: Establishes the convention center district to develop uses and activities to promote use of the convention center. Establishes policies to guide development within the district.

RELATING TO ANIMALS. Establishes a spay and neuter special fund and allows funds from an income tax check-off to be deposited into the special fund. Establishes an advisory committee to assist the department of budget and finance in establishing eligibility criteria and procedures for disbursement from the spay and neuter special fund.

RELATING TO EARLY LEARNING. Permits a taxpayer to designate a specified amount of the taxpayer's income tax refund to be deposited into the Early Learning Trust Fund.

RELATING TO EDUCATION. Establishes the Hawaii public schools science and technology trust fund to support the teaching and learning of science and technology in Hawaii's public schools. Authorizes income tax return designations to the trust fund.

RELATING TO PUBLIC WORKS. Establishes the Wage and Hour for Public Works Projects Special Fund and establishes and funds additional labor law enforcement specialist IV positions to assist the enforcement of Hawaii's wage and hour law on public construction projects. Specifies a funding mechanism for the special fund and requires an annual report. Effective July 1, 2012.

RELATING TO LABOR. Requires employers to provide meal breaks for employees who work more than a total of five hours a day. Imposes penalties for failure to provide meal breaks. Clarifies that the penalty is based on an employee's regular hourly rate of pay at the time the infraction occurred. Effective December 31, 2057.

RELATING TO COLLECTIVE BARGAINING. Repeals the prohibition of using arbitration to resolve impasses or disputes relating to state and county EUTF contributions. Authorizes the arbitration panel to decide on EUTF contributions. Specifies EUTF and group life insurance contributions must be negotiated for active employees. Stipulates that if the Legislature fails to fund a negotiated or arbitrated costs items for EUTF and group life insurance contributions, negotiations on all negotiable items may be reopened. Repeals an obsolete provision.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
