RELATING TO SAFE ROUTES TO SCHOOL. Permanently establishes the Safe Routes to School Program within the Department of Transportation. Establishes a Safe Routes to School Program Special Fund. Assesses a surcharge of $25 for violations of speeding in a school zone and a $10 surcharge on various traffic violations and deposits these surcharges into the Safe Routes to School Program Special Fund. Effective July 1, 2012.

RELATING TO FUNDING FOR PARKING FOR DISABLED PERSONS. Increases the state vehicle registration fee by $1, to be deposited into the Disability and Communication Access Board Special Fund to cover the costs of administering the parking program for persons with disabilities.

RELATING TO TRANSPORTATION. Authorizes the Department of Transportation to extend the term of an airport concession, and to modify and amend the terms of any concession contract, lease, or permit in exchange for revenue-enhancing improvements that are made or paid for by the concession. Effective July 1, 2012.

RELATING TO SPECIAL MANAGEMENT AREA USE PERMITS. Adds a temporary exemption from the Special Management Area Use and Minor Permit requirements for airport development that is necessary to comply with Federal Aviation Administration regulations.

RELATING TO TRANSPORTATION. Reduces remittance of rental vehicle surcharge to the general fund from $4.50 to $3.50. Extends sunset date for Act 104, sections 4 and 5, SLH 2011, from 2012 to 2017.

RELATING TO THE COMMERCIAL HARBORS. Amends chapter 266, Hawaii Revised Statutes, to clarify that persons cited for non-criminal violations are subject to administrative appeal and not District Court. Clarifies that enforcement agents such as the harbor master, harbor agents, facility security officer, or district manager can issue citations for criminal violations. Provides that penalties and fines are deposited into the Harbor Special Fund. Allows the Department of Transportation to seek reimbursement from tenants or harbor users that violate security rules in harbor secured areas thereby causing a fine or penalty from the U.S. Coast Guard to be levied on the Department of Transportation.

RELATING TO SHIPPING. Establishes a working group to explore options for reducing the shipping time and costs for transporting goods from Molokai and Lanai to Oahu. Effective July 1, 2057.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
