RELATING TO CREDIT FOR TIME OF DETENTION PRIOR TO SENTENCE. Clarifies that defendants may not earn credit on a sentence imposed for a subsequent conviction for time being served on a previous felony conviction. Effective January 7, 2059.

RELATING TO CONDITIONAL RELEASE. Requires tolling of one‑year conditional release for a ninety day period commencing upon service of a motion for revocation of conditional release or motion to modify conditions. Effective January 7, 2059.

RELATING TO BAIL. Establishes a new part under Chapter 804, Hawaii Revised Statutes (HRS), to provide comprehensive oversight and regulation of bail bond agents. Establishes procedures for the exoneration of bail bond agents and sureties from bond liabilities and enforcement procedures for compensated sureties. Effective January 7, 2059.

RELATING TO DEBT COLLECTION. Authorizes the Attorney General to collect accounts delinquent for more than ninety days for the departments, except the Department of Taxation and University of Hawaii, and retain an unspecified percent of moneys recovered for deposit into a newly-established fund. Allows the Judiciary, Department of Taxation, and the University of Hawaii to contract a collection agency to collect on delinquent accounts. Effective January 7, 2059.

RELATING TO FALSE CLAIMS TO THE STATE. Brings laws relating to false claims to the state and to the counties into compliance with the federal False Claims Act in order to meet federal requirements that state laws provide the same or greater protections as those established under section 1909 of the Social Security Act.

RELATING TO THE RAP BACK PROGRAM OF THE HAWAII CRIMINAL JUSTICE DATA CENTER. Allows programs statutorily authorized to obtain criminal history record checks on employment and licensing applicants to participate in the rap back program. Effective January 7, 2059.

RELATING TO PRODUCTION OF RECORDS. Adds a new chapter to the Hawaii Revised Statutes allowing judges to order the production of records by persons or entities located outside of the State, in all criminal cases. Requires Hawaii resident served with criminal process from another state to comply with the criminal process. Amends the definition of summons under section 836-1, Hawaii Revised Statutes, to include subpeonas duces tecums. Effective January 7, 2059.

RELATING TO CIVIL UNIONS. Amends various statutory provisions related to civil unions for clarity and conformity. Deletes the eligibility requirement for a civil union requiring termination of an existing reciprocal beneficiary relationship. Authorizes any licensing agent statewide to issue a civil union license. Authorizes the Department of Health to collect fees for civil union licenses. Makes a reciprocal beneficiary relationship automatically terminate upon either party entering into a civil union or marriage that is solemnized. Authorizes name change on the certificate of civil union. Confirms the family court has jurisdiction over the divorce, annulment, and separation of a union that is recognized as a civil union in this State. Effective retroactive to January 1, 2012.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
