RELATING TO ELECTRIC GUNS. Repeals the requirement that the Conservation and Resources Enforcement Program of the Department of Land and Natural Resources meet law enforcement accreditation or recognition standards of the Commission on Accreditation for Law Enforcement Agencies prior to using or obtaining electric guns, related equipment, and training. Effective July 1, 2012.

RELATING TO CONTROLLED SUBSTANCES. Updates chapter 329, Hawaii Revised Statutes, to make it consistent with federal laws on controlled substances. Effective January 7, 2059.

RELATING TO THE SERVICE OF PROCESS. Update the statutes to authorize persons authorized by the rules of court to serve legal process, except criminal process and execute specified court orders. Effective 1/7/2059.

RELATING TO REENTRY INTAKE SERVICE CENTERS. Amends the law to define how pretrial assessments are generated and to provide statutory authority to the Department of Public Safety to supervise persons ordered released from custody by the courts. Effective July 1, 2012.

RELATING TO PRE-SENTENCE REPORTS. Amends the law as it relates to the disposition of convicted defendants by deleting the Intake Service Center as an agency responsible for preparing the pre-sentence diagnosis and report for defendants and for giving notice of the crime victim compensation act and other restitution procedures. Effective July 1, 2012.

RELATING TO AN AUTOMATED VICTIM NOTIFICATION SYSTEM. Establishes the crime victim notification special fund. Requires a 4% surcharge on all inmate commissary purchases, to be deposited into the fund. Requires commission revenue on inmate telephone usage to be deposited into the fund. Effective July 1, 2012.

RELATING TO CRIME. Permits a sentence of probation for certain second-time drug offenders and a three-year probation term for individuals convicted of certain class B and C felonies. Increases the threshold property and services valuation for theft in the second degree to more than $750. Effective January 7, 2059.

RELATING TO PUBLIC SAFETY. Requires a pretrial risk assessment within three working days of commitment to a community correctional center. Increases the membership of the Hawaii paroling authority from 3 to 5 members and requires use of validated risk assessments. Limits length of incarceration for first-time parole violators. Increases the percentage deducted from inmates' earnings for restitution payments. Requires parole supervision prior to maximum sentence date. Adds positions in the PSD. Appropriates funds. Effective 1/7/2059.

RELATING TO PUBLIC SAFETY. Establishes a Wellness Center Task Force within the Legislative Reference Bureau to move forward with the concept of pu‘uhonua, or wellness center, and to establish a location for the wellness center on lands owned or controlled by the State with preference given to the site formerly used as the Kulani Correctional Facility in east Hawaii.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
