RELATING TO ENVIRONMENTAL PROTECTION. Requires businesses in the State to collect a fee for single-use checkout bags provided to a customer. Allows businesses to keep twenty per cent of the fees for the first year of the program and ten per cent of the fees thereafter, subject to income and general excises taxes. Requires fees to be collected on single-use checkout bags not prohibited by county ordinance. Deposits a percentage of fees collected into the natural area reserves fund, and the remainder into the general fund. Requires reports to the legislature. Effective July 1, 2012. (HB2260 HD1)

RELATING TO EMPLOYMENT SECURITY LAW. Amends the procedure for rate determination to clarify that the department's determination must be appealed to the referee and not directly to circuit court.

RELATING TO NOTICE OF WORKERS' COMPENSATION INSURANCE. To allow the Director of Labor and Industrial Relations to accept the notice of employer's workers' compensation insurance from approved third party agencies in a manner and form approved by the director.

RELATING TO WORKERS' COMPENSATION. Clarifies that attorney's fees may be included in costs that may be assessed against a party who brings, prosecutes, or defends a workers' compensation claim without reasonable ground.

RELATING TO LIQUOR. Prohibits the issuance of a liquor license to retailers whose premises at a single location where the liquor would be sold or stored is 100,000 square feet or more. Effective July 1, 2012.

RELATING TO CHAPTER 328J, HAWAII REVISED STATUTES. Permits bars and nightclubs with liquor licenses to allow smoking by posting "smoking permitted" signs and provides that no county ordinance shall prohibit or restrict smoking in these establishments. Effective 1/1/13.

RELATING TO LEASES. Requires lessors of commercial and industrial property to afford lessees the option of renewing their leases. Requires, in leasehold renegotiations, that a rent based on fair market value shall apply even if that value is lower than existing rent and the lease contract bars the lowering of rent upon renegotiation.

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
