RELATING TO PROFESSIONAL EMPLOYER ORGANIZATIONS. Adds powers and duties to the director of labor and industrial relations regarding the registration and regulation of professional employer organizations. Authorizes various penalties for noncompliance with chapter 373L, HRS. Establishes the professional employer special fund to manage the registration of professional employer organizations. Amends certain definitions in chapter 373L, HRS, to make them consistent with definitions in chapter 373K, HRS.

RELATING TO THE SMALL BUSINESS REGULATORY REVIEW BOARD. Transfers the Small Business Regulatory Review Board from the Department of Business, Economic Development, and Tourism to the Department of Commerce and Consumer Affairs, and authorizes the expenses of the board to be funded from the Compliance Resolution Fund; and requires each agency to notify the board on an annual basis of any rules to be amended or repealed to reflect a statutory amendment or repeal.

RELATING TO BROADBAND. Exempts the upgrading and new construction of broadband facilities on state and county property from state and county permitting processes. Effective 07/01/12 to 06/30/17.

RELATING TO BROADBAND. Requires the State and counties to approve, approve with modification, or disapprove all broadband related permits within 45 days. If no action is taken, the application will be deemed approved on the 46th day.

RELATING TO TELECOMMUNICATIONS. Exempts the upgrading of existing wireless broadband facilities from state and county permitting processes. Requires State and counties to give final approval for new wireless infrastructure within 120 days and approve permits for new wireless infrastructure within 45 days. Effective 7/1/12 to 1/1/17.

RELATING TO TELECOMMUNICATIONS AND CABLE TELEVISION SERVICES. Establishes the Hawaii communications commission in DBEDT. Transfers functions relating to telecommunications from the PUC to the Hawaii communications commission. Also transfers functions relating to cable services from DCCA to the Hawaii communications commission. Makes an appropriation.

RELATING TO AEROSPACE HIGH TECHNOLOGY DISTRICTS. Creates aerospace high technology districts in Hawaii. Allows geothermal resource subzones to be designated within aerospace high technology districts; provided that any geothermal energy producers provide a specified percentage of their energy output to any aerospace high technology facility within the district at no cost. Allows nonconforming use of land or buildings in aerospace high technology districts to continue as they exist; provided that no nonconforming use shall be expanded or changed to another nonconforming use without a special permit.

RELATING TO ECONOMIC DEVELOPMENT. Establishes a venture accelerator funding program under the Hawaii strategic development corporation to assist the State's technology businesses to compete for investment capital. Appropriates funds.

RELATING TO PROFESSIONS AND VOCATIONS. Clarifies the definition of "landscape architect". Replaces the existing definition of "surveyor" or "land surveyor" with definitions for "land surveying" and "professional surveyor", "professional land surveyor", or "land surveyor".

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes. This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
