RELATING TO INSURANCE.

Regulates the use of claims history information for homeowners insurance by insurers.

RELATING TO INSURANCE.

Requires viatical settlement providers to be licensed by the insurance commissioner.  Requires the insurance commissioner to establish licensing requirements, fees, and standards for viatical settlement providers.  Permits the commissioner to examine the insurance accounts, records, documents, and transactions of viatical settlement providers.

      Status & Testimony

RELATING TO MOTOR VEHICLES.

Requires motor vehicle insurers to report to the insurance division all existing and newly issued motor vehicle insurance policies, as well as all terminations of and changes to any reported policy, no later than 12/31/2013, and to electronically report the same beginning 1/1/2014.  Requires motor vehicle insurers to inform the insurance division of the DCCA on the method of electronic transmission that each insurer will utilize to report insurance information to the insurance division no later than 6/30/2013.  Beginning 1/1/2014, prohibits renewal of registration of a motor vehicle registered in this State without satisfactory evidence of financial responsibility.

RELATING TO RESIDENTIAL REAL PROPERTY.

Requires that condominium property managers, associations of apartment owners, and planned community associations make association documents available to owners under reasonable terms, including through a property management company's or association's website, if one exists, and for reasonable costs.

RELATING TO TENANCY.

Prohibits adoption of bylaws that require owner to obtain approval of association to rent or lease or for a particular tenant, provided that rental or lease agreement requires tenant to comply with bylaws and owner indemnifies association for any loss caused by tenant.

RELATING TO CONDOMINIUMS.

Creates the option for members of associations of apartment owners to access an association membership list and contact information for vendees under an agreement of sale in an electronic form.

RELATING TO CONDOMINIUMS.

Allows a condominium board to authorize the installation of separate utility meters, notwithstanding the provisions of a project's declaration or association's bylaws, provided that the association pays the cost of installing the meters.

RELATING TO CONDOMINIUMS.

Requires that petitioners have adequate time to address concerns at a requested special association meeting.  Prohibits a board to adopt any rule for association meetings that would require a majority of the quorum vote to change.

RELATING TO ARBITRATION.

Establishes a process by which licensed or certified, unbiased real estate appraisers are used for arbitration proceedings to determine the fair market value, fair market rental, or fair and reasonable rent of real property.  Requires the DCCA to provide a list of appraisers meeting certain criteria.
