SENATE CONCURRENT
RESOLUTION
REQUESTING THE AUDITOR TO CONDUCT A FISCAL AUDIT OF THE KAHO‘OLAWE Rehabilitation TRUST FUND.
WHEREAS, through Act 340, Session Laws of Hawaii 1993, the Legislature placed the island of Kaho‘olawe, a place of extraordinary cultural significance, under the control of the Kaho‘olawe Island Reserve Commission; and
WHEREAS, the Kaho‘olawe Island Reserve Commission establishes policies for and controls uses of the Kaho‘olawe Island Reserve; coordinates the environmental restoration of the Kaho‘olawe Island Reserve; and provides for the perpetuation of native Hawaiian customs, beliefs, and practices; and
WHEREAS, section 6K-9.5, Hawaii Revised Statutes, establishes the Kaho‘olawe Rehabilitation Trust Fund and authorizes the Kaho‘olawe Island Reserve Commission to use monies in the fund to carry out the purposes of chapter 6K, Hawaii Revised Statutes; and
WHEREAS, the Legislature finds that a fiscal audit of the Kaho‘olawe Rehabilitation Trust Fund will be useful to determine whether the use of the funds are in compliance with state laws and any applicable grant agreements and to assess whether the funds are being appropriately used to effectuate the purposes of chapter 6K, Hawaii Revised Statutes, including the duties and responsibilities of the Kaho‘olawe Island Reserve Commission; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, the House of Representatives concurring, that the State Auditor is requested to conduct a fiscal audit of the Kaho‘olawe Rehabilitation Trust Fund that includes a determination of whether the funds are being used in compliance with state laws, in compliance with any applicable grant agreements, and to effectuate the purposes of chapter 6K, Hawaii Revised States, including the performance of duties and responsibilities of the Kaho‘olawe Island Reserve Commission; and
BE IT FURTHER RESOLVED that the Auditor is requested to report the findings of the audit to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, Chairperson of the Kaho‘olawe Island Reserve Commission, and Auditor.
