A BILL FOR AN ACT
RELATING TO Energy conservation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§196- Prohibition on the sale or use of certain electrical items. (a) After December 31, 2011, no person, business, or other entity in this State shall sell or use any of the following electrical items:
(1) Incandescent lights;
(2) Electric resistance water heaters; or
(3) Any water heater that is less than one hundred per cent efficient in using its electrical energy to heat water or uses an electric resistance element to heat water, unless the water heater is used in conjunction with a solar power water heating system.
(b) Subsection (a) shall not apply to the following:
(1) Any federal government agency or department;
(2) Any state agency or department that necessitates the use of incandescent lights to protect the safety and welfare of persons in this State; or
(3) Any contract executed prior to January 1, 2012.
(c) Any violation of subsection (a) shall result in a fine of not less than $ nor more than $ .
(d) For purposes of this section:
"Electric resistance element" means an object that measures a material's strength of resistance during the passage of an electrical current.
"Electric resistance water heater" means a water heating device that uses an electric resistance element to heat water.
"Incandescent lights" means light bulbs that emit light as a consequence of the bulb's filament being heated to a temperature greater than four thousand degrees Fahrenheit."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval; provided that section 196- (c), Hawaii Revised Statutes, shall not take effect until January 1, 2012.
