A BILL FOR AN ACT
relating to INTOXICATING LIQUOR.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§281- _ Caffeinated or stimulant-enhanced malt beverages; prohibition. (a) No person shall sell, offer for sale, or otherwise distribute any caffeinated or stimulant-enhanced malt beverage in the State.
(b) As used in this section, "caffeinated or stimulant-enhanced malt beverage" means beer or malt or fermented liquor, to which is added caffeine or other stimulants, including but not limited to guarana, ginseng, or taurine, and contains at least one-half of one per cent alcohol by volume."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
