A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLE TIRES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that discarded motor vehicle tires continue to blight Hawaii's neighborhoods, particularly in rural and isolated areas.  With the repeal of the motor vehicle tire surcharge, the department of health lost a vital source of funding to promote tire recovery and prevent illegal dumping.  Subsequent personnel and operating budget cuts have made it difficult for the department to address this critical issue.

     The purpose of this Act is to reestablish the motor vehicle tire surcharge and establish a task force to study ways to prevent or control the problem of abandoned tires littering the landscape.

     SECTION 2.  Chapter 342I, part II, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342I-    Motor vehicle tire surcharge.  (a)  There is established a motor vehicle tire surcharge on tires imported into the State after September 30, 2012.  The motor vehicle tire surcharge shall be $1 per tire imported into the State and shall include those tires imported on motor vehicles, and their associated spare tires.  Motor vehicle rental companies and companies that sell vehicles to motor vehicle rental companies may subtract the number of tires on motor vehicles that are exported from the State when calculating the motor vehicle tire surcharge.  Upon approval of the director of health, a motor vehicle rental company that purchases new motor vehicles, within the State, may be designated as the importer of motor vehicles.  No demand shall be made on the State for payment of surcharge credit if the number of exported motor vehicles exceeds the number of imported motor vehicles in any reporting period.

     (b)  Beginning January 1, 2013, the surcharge shall be paid by the person or entity who imports the tires, including importers of motor vehicles, within ninety days after receiving the tires imported into the State."

     SECTION 3.  (a)  The director of health shall convene a task force that shall study ways to prevent or control the problem of abandoned tires littering the landscape.

     (b)  The task force shall be composed of:

     (1)  The director of health, or the director's designee;

     (2)  The chairperson of the board of land and natural resources, or the chairperson's designee;

     (3)  A representative of the city and county of Honolulu department of environmental services;

     (4)  A representative of the Honolulu police department;

     (5)  Elected officials of affected communities as determined by the department of health;

     (6)  A representative from each of the neighborhood boards of affected communities, as determined by the department of health;

     (7)  A representative of the tire recycling industry, to be selected by the department of health;

     (8)  A representative of the vehicle recycling industry, to be selected by the department of health;

     (9)  A representative of tire retailers, to be selected by the department of health; and

    (10)  A representative of automobile dealers, to be selected by the department of health.

     (c)  The task force shall be administratively attached to the department of health.

     (d)  No member of the task force created by this measure shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation on the task force.

     SECTION 4.  Members of the task force shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     SECTION 5.  The task force shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days before the convening of the regular legislative session of 2014, and shall be dissolved on December 31, 2013.

     SECTION 6.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2012.
