SENATE FLOOR AMENDMENT
FLOOR AMENDMENT NO. Date
SECTION 1. Senate Bill No. 2923, S.D. 2, is amended as follows:
1. By amending section 2, page 4, lines 3-6, to read:
"(1) Opihi taken or harvested for noncommercial purposes from above the waterline during the open seasons may be possessed for sale or consumption during the closed seasons; and"
2. By amending section 2, page 5, lines 8-13, to read:
"§188-B Opihi harvesting or taking; Oahu; prohibited. Except as provided in section 188-A(f), and notwithstanding any other provision to the contrary, until June 30, 2017, it shall be unlawful for any person at any time to take or harvest opihi for commercial purposes from the coastal areas or nearshore waters of the island of Oahu.""
3. By adding a new section 3 to read:
"SECTION 3. Section 188-42.5, Hawaii Revised Statutes, is amended to read as follows:
"[[]§188-42.5[]]
Hihiwai, hapawai, [and], opae kala‘ole, and opihi
selling prohibited. (a) It shall be unlawful for any person at any
time to sell or offer for sale any hihiwai, hapawai, and opae kala‘ole taken
from any of the waters within the jurisdiction of the State[.];
provided that it shall be unlawful to sell or offer for sale for commercial
purposes any opihi taken from any of the waters within the jurisdiction of the
State."
4. By renumbering the remaining sections to read:
"SECTION 4."
"SECTION 5."
"SECTION 6."
