A BILL FOR AN ACT

 

 

RELATING TO THE HOMELESS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Part XVII of chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Designated safe facilities; established.  (a)  The homeless programs office of the department shall establish designated safe facilities in various locations throughout the State for homeless persons to reside until permanent housing becomes available.  The designated safe facilities shall provide clean eating areas, showers, toilets, and laundry facilities.

     (b)  The homeless programs office shall establish rules and a code of conduct for individuals, couples, and families residing in the designated safe facilities.  The office shall have the authority to take appropriate action should a homeless individual, couple, or family not comply with the rules or participate in any illegal activity while residing in the designated safe facilities.  The office may establish a minimum fee to live in the designated safe facilities; provided that any fees collected shall be used to offset expenses associated with the establishment and maintenance of the designated safe facilities.

     (c)  The homeless programs office shall partner with community and nonprofit organizations in good standing with the State to provide homeless support services for homeless persons who reside in the designated safe facilities.  The office shall coordinate with state and county law enforcement officials to establish adequate security for the safety of individuals in the designated safe facilities.

     (d)  The department shall adopt rules, pursuant to chapter 91, to implement this section."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2012-2013 to establish designated safe facilities pursuant to this Act.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Requires and appropriates funds for the homeless programs office of the DHS to establish designated safe facilities for homeless persons to live until permanent housing becomes available.  Requires the homeless programs office to establish rules and a code of conduct for the designated safe facilities.  Requires partnership with nonprofit and community service organizations and coordination with state and county law enforcement officials for the safety of individuals residing in the designated safe facilities.  Effective 7/1/2050.  (SD2)
