A BILL FOR AN ACT
relating to landfills.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to establish a host municipality benefit fee to be paid by operators of privately owned or operated recovery facility or landfills to offset the impact of the facility.
SECTION 2. Chapter 342G, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342G- Host municipality benefit fee. (a) Each operator of a privately owned or operated resource recovery landfill, excluding transfer stations, shall pay a host municipality benefit fee to the county in which the facility or landfill is located. The fee shall be a tax of $4 per ton of solid waste processed at the facility.
(b) The host municipality benefit fee shall increase on January 1 of every year by at least cents, but by no more than cents. The fee shall be in lieu of all taxes, fees, charges, or assessments imposed by the county in which the facility or landfill is located, except for real estate taxes imposed solely upon the land on which the facility or landfill is located.
(c) The counties shall transfer all collected fees to the department of health on a quarterly basis, and the department of health shall deposit the fees into the environmental management special fund."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
