A BILL FOR AN ACT
RELATING TO environmental HEALTH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46‑ County pollution inspection advisor. (a) The mayor of each county shall appoint a volunteer county pollution inspection advisor to advise the state department of health as provided in section 321‑ ; provided that the mayor shall select the county pollution inspection advisor from a list of nominees submitted by the neighborhood board of any community in that county in which is located a sanitary landfill, open dump, or incineration facility regulated under chapter 342H or a hazardous waste management facility regulated under chapter 342J. If the county has no neighborhood board system, the mayor shall appoint the pollution inspection advisor. County pollution inspection advisors shall serve without pay. County or state employees shall not be eligible for appointment as a county pollution inspection advisor.
(b) The county shall develop and adopt the necessary procedures to implement this section in accordance with the county charter and ordinances."
SECTION 2. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§321‑ County pollution inspection advisor. The department of health shall establish a volunteer position of county pollution inspection advisor for each county. The mayor of each county shall select a person to fill the position of county pollution inspection advisor as provided in section 46‑ . The volunteer shall be appointed without regard to chapters 76, 78, 87A, or 88. The duties of each county pollution inspection advisor shall be to:
(1) Advise the department of health on matters within each advisor's respective county on permitting, inspection, safety, and enforcement issues concerning environmental regulation and pollution control under chapters 342H or 342J; and
(2) Conduct inspections of private property that poses a potential of causing an environmentally-related human illness or injury, as defined in section 321-312."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
