A BILL FOR AN ACT

relating to public safety.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 138, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§138-    Provision of call location information by communications service provider to public safety agency. (a)  Upon request of a public safety agency or a public safety answering point on behalf of a public safety agency, a communications service provider shall provide call location information to the public safety agency or public safety answering point; provided that the information requested under this section is for the purposes of responding to a call for emergency services or to an emergency situation that involves the risk of death or serious physical harm.

(b)  Pursuant to the limitation of liability under section 138-9(a), no cause of action shall lie in any court against any communications service provider or its officers, employees, or agents for providing call location information in good faith under this section.

(c)  All communications service providers authorized to do business in this State shall submit their contact information to the attorney general to facilitate requests for call location information under this section.  The attorney general shall disseminate the contact information to each public safety answering point in this State.

(d)  Nothing in this section shall be construed to prohibit a communications service provider from establishing protocols by which the communications service provider voluntarily discloses call location information.

(e)  For the purposes of this section, "call location information" means information indicating the geographical location of a telecommunications device or from which the location can be determined."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
