A BILL FOR AN ACT
RELATING TO EMPLOYMENT PRACTICES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that there is growing concern over an emerging national trend of employers, employment agencies, staffing firms, and recruiters reportedly posting job notices or published advertisements expressly that exclude unemployed applicants from job consideration. In particular, this reported employment practice raises concerns over disparate impacts on racial minorities, women, persons with disabilities, and younger and older workers, as these groups have higher rates of unemployment nationally and in specific markets. The exclusion of otherwise qualified applicants who are unemployed also raises broader concerns for the employment prospects of the nearly fourteen million unemployed and over four million long-term unemployed in our country, and concerns that current employment is a poor proxy for qualification and job performance in the job selection process.
To date, this emerging practice of excluding the unemployed from applicant pools for employment opportunities has not been reported in Hawaii. Because there is little or no available data in the State or nationally, the occurrence of this exclusionary employment practice will be largely documented on an anecdotal or case-by-case basis, if and when exclusionary postings or advertisements are published.
The legislature finds that the employment practice of employers or employment agencies publishing or causing to be published any job notice or job advertisement excluding the unemployed from consideration for a job vacancy is against public policy.
The purpose of this Act is to direct the legislative reference bureau to gather information and data on the occurrence of this exclusionary employment practice in Hawaii and report to the legislature, so that the legislature may determine whether legislation is needed to prohibit this practice.
SECTION 2. (a) The legislative reference bureau shall conduct a study and gather information and data on whether employers and employment agencies are engaging in employment practices that exclude the unemployed from qualified applicant pools considered for employment in Hawaii.
(b) The study shall include:
(1) A review and survey of job notices and job advertisements published in newspapers or posted on the Internet that exclude the unemployed from consideration for a job vacancy; and
(2) A count of any complaints involving exclusion of the unemployed from consideration for a job vacancy filed with the Hawaii civil rights commission.
(c) The Hawaii civil rights commission shall provide assistance and information as necessary for the legislative reference bureau to conduct the study.
(d) The legislative reference bureau shall submit a report of its findings, including examples of any posted notices or published advertisements that exclude the unemployed from consideration for a job vacancy, to the legislature no later than twenty days prior to the convening of the regular session of 2013.
SECTION 3. This Act shall take effect upon its approval.
