A BILL FOR AN ACT
RELATING TO STATE-OWNED WORKS OF ART.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§103- State-owned works of art exposed to the elements; care, maintenance, and repair paid for by private contributors. (a) Whenever feasible, the State may accept contributions from private individuals or entities for the purpose of caring for, maintaining, and repairing a work of art that is owned by the State and displayed where it is exposed to the elements. The comptroller may enter into an agreement to have the name of the contributing private individual or entity displayed on a plaque or placard placed adjacent to the work of art.
(b) To qualify to have the name of a private individual or entity displayed as described in subsection (a), the private individual or entity shall execute a contract with the comptroller that requires the private individual or entity to contribute not less than one hundred per cent of the total cost of the care, maintenance, and repair of the subject work of art for a period of time as specified in the contract.
The comptroller may establish a limit on the length of time that the plaque or placard shall be displayed based upon the contribution from the private individual or entity. In addition, the comptroller may reserve the right, in the comptroller's discretion, to reject or alter the name of a contributing private individual or entity to be placed on the plaque or placard.
(c) The department of accounting and general services shall adopt rules pursuant to chapter 91 to implement this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
