A BILL FOR AN ACT
relating to INTOXICATING LIQUOR.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§281- Caffeinated alcoholic beverage; intoxicating liquor. (a) No person shall sell, offer for sale, advertise, or otherwise distribute any caffeinated alcoholic beverage in the State unless the caffeinated alcoholic beverage is labeled as an "intoxicating liquor" and contains a warning that the potential harmful effects of consuming a caffeinated alcoholic beverage may be similar to potential harmful effects of consuming an intoxicating liquor.
(b) As used in this section, "caffeinated alcoholic beverage" means any spirituous, vinous, malt or fermented liquor, liquids, and compounds, whether medicated, proprietary, patented, or not, in whatever form and of whatever constituency and by whatever name called, containing any per cent of alcohol by volume and any per cent of caffeine by volume, which are fit for use or may be used or readily converted for use for beverage purposes."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
