A BILL FOR AN ACT

 

 

RELATING TO UNEMPLOYMENT COMPENSATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that unemployed persons spend all or most of their unemployment compensation within the State.  The legislature also finds that the benefit of those expenditures will be maximized by temporarily exempting unemployment compensation from state income taxation.

     The purpose of this Act is to promote economic revitalization within the State by temporarily exempting, from state income taxation, unemployment compensation received by certain persons.

     SECTION 2.  Chapter 235, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§235-     Unemployment compensation; exclusion.  (a)  Except as otherwise provided under subsection (b), the gross income, adjusted gross income, and taxable income of an individual taxpayer during a taxable year shall exclude any unemployment compensation received by the taxpayer during that taxable year.

     (b)  The exclusion under subsection (a) shall not apply to an individual taxpayer's gross income, adjusted gross income, or taxable income during a taxable year in which:

     (1)  The individual taxpayer receives more than $28,800 in gross income from sources other than unemployment compensation;

     (2)  The individual taxpayer's spouse receives more than $48,000 in gross income from sources other than unemployment compensation, whether or not they file individual returns or a joint return; or

     (3)  Both subsections (a) and (b) occur.

     (c)  For the purpose of this section, "unemployment compensation" means the same as defined under section 85 of the Internal Revenue Code.

     (d)  This section shall apply to taxable years beginning after December 31, 2010, and shall end with the taxable year beginning after December 31, 2014."

     SECTION 3.  Section 235-2.3, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The following Internal Revenue Code subchapters, parts of subchapters, sections, subsections, and parts of subsections shall not be operative for the purposes of this chapter, unless otherwise provided:

     (1)  Subchapter A (Sections 1 to 59A) (with respect to determination of tax liability), except Section 1(h)(2) (relating to net capital gain reduced by the amount taken into account as investment income), except Sections 2(a), 2(b), and 2(c) (with respect to the definition of "surviving spouse" and "head of household"), except Section 41 (with respect to the credit for increasing research activities), except Section 42 (with respect to low-income housing credit), except Sections 47 and 48, as amended, as of December 31, 1984 (with respect to certain depreciable tangible personal property), and except Section 48(d)(3), as amended, as of February 17, 2009 (with respect to the treatment of United States Department of Treasury grants made under Section 1603 of the American Recovery and Reinvestment Tax Act of 2009).  For treatment, see sections 235-110.91, 235-110.7, and 235-110.8;

     (2)  Section 78 (with respect to dividends received from certain foreign corporations by domestic corporations choosing foreign tax credit);

     (3)  Section 85 (with respect to unemployment compensation), from the taxable year beginning after December 31, 2010, and ending with the taxable year beginning after December 31, 2014.  For treatment, see section 235-   ;

    [(3)] (4)  Section 86 (with respect to social security and tier 1 railroad retirement benefits);

     SECTION 4.  Section 235-2.4, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  Section 85 (with respect to unemployment compensation) of the Internal Revenue Code shall be operative for purposes of this chapter, except that Section 85(c) shall not be operative for purposes of this chapter[.]; provided that from the taxable year beginning after December 31, 2010, and ending with the taxable year beginning after December 31, 2014, section 85 shall not be operative for the purposes of this chapter."

     SECTION 5.  Section 383-163.6, Hawaii Revised Statutes, is amended by amending the title and subsection (a) to read as follows:

     "[[]§383-163.6[]]  Voluntary deduction and withholding of federal and state or local income taxes.  (a)  An individual filing a new claim for unemployment compensation [shall], at the time of filing the claim, shall be advised that:

     (1)  Unemployment compensation is subject to federal [and state] income tax[;] and may be subject to state or local income tax;

     (2)  Requirements exist pertaining to estimated tax payments;

     (3)  The individual may elect to have federal income tax deducted and withheld from the individual's payment of unemployment compensation at the amount specified in the federal Internal Revenue Code;

     (4)  The individual may elect to have state income tax deducted and withheld from the individual's payment of unemployment compensation at the amount specified in section 235-69;

     (5)  The individual may elect to have state and local income taxes deducted and withheld from the individual's payment of unemployment compensation for other states and localities outside this State at the percentage established by the state or locality, if the department by agreement with the other state or locality is authorized to deduct and withhold income tax; and

     (6)  The individual shall be permitted to change a previously elected withholding status no more than once during a benefit year."

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act, upon its approval, shall apply to taxable years beginning after December 31, 2010.
