A BILL FOR AN ACT
RELATING TO MEDICAID.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§346- Medicaid prescription drug benefits; copayment. (a) A medicaid recipient shall be required to pay a copayment for prescription drugs covered under the recipient's medicaid benefits in accordance with a system established by the department; provided that a copayment shall not be required for prescription drugs for recipients under twenty-one years of age, terminally ill recipients certified at hospice level of care, or recipients residing in nursing homes or in home- or community-based settings that provide a certified intermediate care facility or skilled nursing facility level of care.
(b) The department shall adopt rules in accordance with chapter 91 to establish and implement a medicaid prescription drug benefit copayment system that is in accordance with federal medicaid regulations for out-of-pocket charges."
SECTION 2. Prior to the establishment and implementation of the medicaid prescription drug benefit copayment system required under section 346- , Hawaii Revised Statutes, the department of human services shall develop the medicaid prescription drug benefit copayment system and seek the approval of the Centers for Medicare and Medicaid Services for such system.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
