A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XVII to be appropriately designated and to read as follows:

     "§291C-    Green hybrid vehicle; zipper lanes.  (a) Notwithstanding any other law to the contrary, the director of transportation shall allow the use of green hybrid vehicles, regardless of the number of occupants, in contraflow lanes that have been designated as zipper or zip lanes by the department of transportation.

     (b)  The director of transportation shall adopt rules in accordance with chapter 91 necessary to effectuate this section."

     SECTION 2.  Section 291C-221, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Green hybrid vehicle" means a motor vehicle that:

     (1)  Has been certified by the United States Environmental Protection Agency as meeting the tier II emission level and to have achieved not less than a fifty per cent increase in city fuel economy and not less than a forty-five per cent increase in combined city-highway fuel economy relative to an internal combustion gasoline-fueled vehicle; and

     (2)  Draws propulsion energy from more than one on-board source of stored energy, including both an internal combustion or heat engine using consumable fuel and a rechargeable battery or fuel cell."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2012, and shall be repealed on June 30, 2016.
