A BILL FOR AN ACT
RELATING TO BROADBAND.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. (a) Notwithstanding any law, rule, or county ordinance to the contrary, from July 1, 2012, to June 30, 2017, any actions relating to the installation, improvement, construction, upgrading, or development of new or existing broadband facilities on state buildings, and the property on which the state buildings are located, shall be exempt from county permitting requirements and state permitting and approval requirements, including but not limited to the requirements of chapters 171, 205A, and 343, Hawaii Revised Statutes, except to the extent that the permitting or approval is required by federal law or is necessary to protect eligibility for federal funding, services, or other assistance.
(b) An entity taking any action under subsection (a) shall provide at least thirty days notice to the director of commerce and consumer affairs by electronically posting the proposed action on a website designated by the director; provided that notice need not be given by a public utility or government entity for an action relating to the installation, improvement, construction, or development of broadband facilities where the action taken is to provide access for state functions.
(c) For purposes of this section, "broadband facilities" means infrastructure relating to broadband services or broadband technology, including the interconnection of cables, towers, antenna support structures, utility poles, and conduits.
SECTION 2. The director of commerce and consumer affairs shall submit a report to the legislature no later than twenty days prior to the convening of the regular session of 2016 that includes:
(1) Information on the number of permitting exemptions granted pursuant to this Act; and
(2) Recommendations on whether to extend or modify the exemptions provided by this Act, including any proposed legislation.
SECTION 3. This Act shall take effect on July 1, 2012, and shall be repealed on June 30, 2017.
