A BILL FOR AN ACT
RELATING TO WORKERS' COMPENSATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that adequate reimbursement to healthcare providers for workers' compensation services is a serious concern. Over time, the reimbursement rates of healthcare providers have failed to keep pace with the higher costs of medical care, leading some physicians to opt out of providing workers' compensation services.
SECTION 2. The office of the auditor shall conduct a study on the workers' compensation reimbursement system in Hawaii. The study shall analyze the concerns within the healthcare community about the difficulty in providing healthcare services in workers' compensation cases due to their low reimbursement rates, including:
(1) A determination of any problems within the current workers' compensation reimbursement system;
(2) Specifying and analyzing currently implemented remedies made to address any problems;
(3) Identifying additional remedies that could improve the workers' compensation reimbursement system in Hawaii;
(4) A study of the costs of workers' compensation services and whether healthcare providers are adequately reimbursed for their actual costs;
(5) A comparison of processes implemented by other jurisdictions or as recommended by experts that try to ensure that state-funded health care payments to workers' compensation providers adequately reimburse health care providers; and
(6) A proposed method of relief to healthcare providers for workers' compensation services.
SECTION 3. The office of the auditor shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2013.
SECTION 4. This Act shall take effect on July 1, 2012.
