A BILL FOR AN ACT

relating to condominiums.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 514A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§514A-  Prohibition on smoking; fines. Notwithstanding any provision of law, the declaration, or bylaws to the contrary, an association may adopt rules or regulations that prohibit smoking within common elements or limited common elements of the project.  A board may assess fines not to exceed $100 for the first violation and $200 for each subsequent violation of a rule or regulation that prohibits smoking within areas of the project."

     SECTION 2.  Chapter 514B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§514B-  Prohibition on smoking; fines. Notwithstanding any provision of law, the declaration, or bylaws to the contrary, an association may adopt rules or regulations that prohibit smoking within common elements or limited common elements of the project.  A board may assess fines not to exceed $100 for the first violation and $200 for each subsequent violation of a rule or regulation that prohibits smoking within areas of the project."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
