A BILL FOR AN ACT

 

 

relating to LaBELING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 486, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§486-    Fresh fruits and fresh vegetables; declaration of geographic origin.  No person shall offer, display, expose for sale, or solicit for the sale of, including in association with advertising media, a perishable consumer commodity that is a fresh fruit or fresh vegetable without providing a declaration of the geographic origin of the fresh fruit or fresh vegetable.

     §486-    Baked goods; notice of preparation date.  No person shall keep, offer, display, or expose for sale a perishable consumer commodity that is a baked good that was prepared in the State that does not bear a label indicating the date on which the baked good was prepared, in addition to all other labeling and branding requirements."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
