A BILL FOR AN ACT

 

 

relating to liability.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 663, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§663-     Public agencies; farmers markets; indemnification.  (a)  The State or county, as the case may be, shall indemnify a public agency from any liability that arises from the sale of food or food products by a vendor at a farmers market held on the agency's property.  This section shall not apply to food or food products sold by cafeteria contractors at the farmers market.

     (b)  For the purposes of this section, "public agency" means the same as in section 103D-1001."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
