A BILL FOR AN ACT
RELATING TO THE MOTOR VEHICLE RENTAL INDUSTRY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 437D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§437D- Additional driver fee prohibited; exception. (a) No lessor or officer, employee, agent, or other representative of the lessor shall assess a daily additional driver fee against a lessor, except as otherwise provided in this section.
(b) A lessor or officer, employee, agent, or other representative of the lessor may assess, against any lessee who is twenty-five years of age or older, a one-time, additional driver fee of not more than $10 for each additional driver. The one-time fee shall be valid for the duration of the contract.
(c) The restriction on the assessment and collection of an additional driver fee established in this section shall not apply to any additional driver who is under twenty-five years old."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
