A BILL FOR AN ACT
RELATING TO CULTURE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A- After-school plus program; Hawaiian cultural programs. (a) The department shall include in the after-school plus program, as funded under section 302A-1149.5, activities in Hawaiian language, culture, or art as part of the activities offered to all participating children.
(b) Individual schools may require the after-school plus program conducted on their campuses to include a kupuna program, through which Hawaiian language, culture, and art is taught by community elders. A school may obtain the services of persons in a voluntary or unpaid capacity, exempt from chapter 76, as may be necessary to carry out the purposes of this section, and may regulate their duties, powers, and responsibilities when not otherwise provided by law. Any person whose services have been so accepted, while engaged in the performance of duty under this section, shall be deemed a state employee in determining the liability of the State for the negligent acts of these persons.
(c) The department or individual schools may fulfill the requirements of this section by incorporating into after-school plus programs an existing program that substantially meets the requirements of this section.
(d) The department may adopt rules in accordance with chapter 91 to carry out the purposes of this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
