RELATING TO BUILDING DESIGN FOR PERSONS WITH DISABILITIES.

Allows the Disability and Communication Access Board to charge fees to defray expenses of reviewing construction plans to ensure compliance with law.  Establishes an Accessible Building Design Special Account for plan review fees and cost of compliance with ADA design requirements.  Effective January 1, 2012.  (HB756 HD1)

RELATING TO TRESPASS.

RELATING TO HISTORIC PRESERVATION.

Establishes a special account within the Hawaii Historic Preservation Special Fund and requires that archaeological permit fees collected be deposited into the account to cover the costs of managing the permits.  Directs the Department of Land and Natural Resources to increase permit fees over time.  (HB224 HD1)

RELATING TO THE KAHOOLAWE ISLAND RESERVE.

Authorizes a portion of the conveyance tax revenues to be used to replenish the Kahoolawe rehabilitation trust fund for the long-term restoration of Kahoolawe.

Eliminates the public auction requirement for the disposition of easements on county property for a specific purpose.

RELATING TO STREAMLINING PERMIT, LICENSE, AND APPROVAL APPLICATION PROCESSING.

Authorizes counties to contract with a third-party reviewer to streamline construction permit, license, and other application processing; provides that applications will be deemed approved if historic preservation division fails to review and comment within 60 days, and after 30 days if agencies fail to establish maximum time periods for permit and other application processing.

RELATING TO TAXATION.

Authorizes a county to levy a one-half per cent surcharge on state general excise tax and use tax to be used for county water infrastructure, including drainage improvements, wastewater infrastructure, and reclaimed water infrastructure.

RELATING TO CONSERVATION.

Requires the revenues of the land conservation fund from the conveyance tax to be temporarily expended for invasive species control and mitigation, reforestation, and sediment run-off control.

RELATING TO CONVEYANCE TAX.

Requires the director of taxation to provide the administrator of each county's real property assessment division with an image of all certificates of conveyances filed with the bureau of conveyances within ten days after the end of each week.

RELATING TO TAXATION.

Imposes conveyance tax on the transfer of a controlling interest of an entity with an interest in real property.  Imposes the conveyance tax on certain transfers of real property at the lowest tax rate.

RELATING TO A CONTROLLING INTEREST TRANSFER TAX.

Establishes a controlling interest transfer tax imposed at the rate set under the conveyance tax, to be administered by the Director of Taxation on any transfer of interest of more than 50 percent in an entity holding real property in the state.

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
