RELATING TO HIGHWAYS. Authorizes the department of transportation to pursue a comprehensive six-year modernization program and provides it sufficient resources to implement the plan by amending the state liquid fuel tax, state vehicle registration fee, state vehicle weight fee, and rental motor vehicle surcharge through increases of the various taxes and the flat rate amount in sections 243-4(a), 249-31, 249-33(a), and 251-2(a), Hawaii Revised Statutes. Authorizes the implementation of a Vehicle Miles Traveled Pilot Program.

RELATING TO HIGHWAYS. Requires, effective 1/1/12, that all new lighting fixtures installed on public highways to be fully or partially shielded, to minimize glare and light pollution.

RELATING TO MOTORIZED VEHICLES. Requires the Director of Transportation, rather than the counties, to regulate mopeds. Requires owners of mopeds and motor scooters to register them with the State and obtain license plates.

RELATING TO TRANSPORTATION. Prohibits motor carriers from being required to enter into agreements to hold harmless from claims or liability for the negligence, intentional acts, or intentional omissions persons entering into a transportation contract or agreement to use the services of, or permit entry onto their premises to a motor carrier.

RELATING TO UNINSURED MOTOR VEHICLES. Prohibits the driver of an uninsured motor vehicle that is involved in an accident from suing any other person. Allows a passenger in an uninsured motor vehicle involved in an accident to sue only the driver of that vehicle.

RELATING TO FUNDING FOR PARKING FOR DISABLED PERSONS. Creates an Accessible Parking Special Account within the Disability and Communication Access Board Special Fund. Increases the state vehicle registration fee by $1, to be deposited into the Accessible Parking Special Account. Requires all costs associated with the statewide Parking Program for Persons with Disabilities to be appropriated from the Accessible Parking Special Account beginning July 1, 2012.

RELATING TO HIGHWAY SAFETY. Clarifies recommendations of the ignition interlock implementation task force. Allows repeat intoxicated drivers to install ignition interlock devices in any vehicle they operate by eliminating the requirement to surrender motor vehicle registrations and license plates. Makes housekeeping amendments to chapter 291E. Extends the expiration date of the ignition interlock implementation task force to 6/30/12.

RELATING TO TRANSPORTATION. Provides increase penalties for the failure to register a motor vehicle or failure to keep a certificate of registration in a motor vehicle. Maintains additional fines within the county in which the violation occurred.

RELATING TO HIGHWAY SAFETY. Requires motor vehicles towing a trailer to be equipped with towing safety apparatus.

RELATING TO TRAFFIC VIOLATIONS. Prohibits motor vehicle mufflers from emitting a noise level above 95 decibels. Authorizes law enforcement officers to issue traffic citations for violations that are correctable.

RELATING TO OPERATION OF MOTOR VEHICLES. Makes it a petty misdemeanor to operate a motor vehicle while using a text messaging device.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
