RELATING TO SERVICE ANIMALS. Adds a definition of "service dog" in provisions relating to dog licensing, to conform with new ADA rules; expands the definition of "service animal" to include "comfort animals", to conform with FHA rules regarding non-discrimination in the sale or rental of housing.

RELATING TO ARMED FORCES SERVICE MEMBERS. Recognizes the federally prescribed DD Form 93, or its successor form, as an acceptable method of determining the person authorized to direct disposition of an armed forces service member's remains.

RELATING TO INTOXICATING LIQUOR. Authorizes the county liquor commissions to require training and certification for liquor servers.

RELATING TO PUBLIC SAFETY. Requires and sets a deadline for the department of public safety to pursue and obtain accreditation for the sheriff division from the Commission on Accreditation for law Enforcement Agencies, Inc.

RELATING TO PUBLIC SAFETY. Addresses the operational deficiencies of the sheriff division of the department of public safety that were highlighted in the auditor's audit of the division. Makes appropriation.

RELATING TO THE DEPARTMENT OF THE SHERIFF. Creates a department of the sheriff to assume responsibilities and functions exercised by the sheriff division of the department of public safety. Makes appropriation.

RELATING TO COLLECTIVE BARGAINING. Creates bargaining unit 14 to represent state law enforcement officers. Clarifies that no election shall be directed by the Hawaii labor relations board in any newly created bargaining unit of employees who are currently covered by a valid collective bargaining agreement.

RELATING TO THE HAWAII PENAL CODE. Beginning 01/01/2012, retroactively requires that multiple terms of imprisonment run concurrently unless the court orders or the law mandates that the terms run consecutively. Effective immediately, directs department of public safety to recalculate the sentences of inmates who submit written requests and, if warranted by the recalculation, release the inmates.

RELATING TO PUBLIC SAFETY. This measure amends section 353-61, Hawaii Revised Statutes, to delete the Hawaii Criminal Justice Association from the panel to nominate members of the paroling authority since the association no longer exists.

RELATING TO CORRECTIONS. Specifies criteria that must be considered in deciding whether to transfer inmates between correctional facilities located in Hawaii and correctional facilities located outside of Hawaii.

RELATING TO CORRECTIONAL FACILITIES. Requires the department of public safety to report to the legislature any inmate or correctional facility employee death within 24 hours.

RELATING TO THE POWER OF ARREST. Adds the federal bureau of investigation and the United States immigration and customs enforcement to the list of federal agencies whose officers may make arrests for certain offenses under state law. Removes the citizenship and immigration services from the list. Adds proper titles of the heads of the district offices for the listed federal agencies.

RELATING TO SENTENCING. Permits certain non-violent repeat offenders convicted of drug possession to be sentenced to alternative programs instead of to prison.

Directs DPS to prepare preliminary design and request for proposals for the design, development, and operation of a correctional treatment facility and to consider the undeveloped portion on the existing Halawa correctional facility as a possible site for the facility. RELATING TO PUBLIC SAFETY. Requires the department of public safety to develop a plan to reopen the Kulani correctional facility, implement transfers, and house newly sentenced individuals. Report to legislature.

When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
