RELATING TO SMOKING. Requires the Department of Taxation to issue smoking establishment permits to establishments and premises that hold certain classes of liquor licenses; requires permit holders to post specified signs; specifies that conflicting county laws shall not supersede state law; makes conforming amendments.

RELATING TO THE DISCLOSURE OF VITAL STATISTICS RECORDS TO LAW ENFORCEMENT OFFICERS. Authorizes the Department of Health to provide certain public health records to law enforcement officers to facilitate criminal investigations.

RELATING TO MENTAL HEALTH RELEASE ON CONDITIONS OF A PERSON FOUND UNFIT TO STAND TRIAL. Requires the Department of Health to provide a fitness restoration program for defendants unfit to proceed with court proceedings and on conditional release. Allows Department of Public Safety to take appropriate action on information shared regarding defendant compliance.

RELATING TO THE HAWAII STATE HOSPITAL. Requires the department of public safety to provide security at the Hawaii state hospital. Requires a report to the legislature on strategies and plans to address the needs for appropriate security and the needs of the increasing and aging forensic population at the Hawaii state hospital.

RELATING TO CORRECTIONS. Prohibits physically restraining pregnant inmates, unless extraordinary circumstances exist.

RELATING TO CORRECTIONS. Adds a section to chapter 353, Hawaii Revised Statutes, relating to the mental health treatment of inmates and detainees in the custody of the Department of Public Safety.

· In person: 1 copy of their testimony to the committee clerk, Room 231, State Capitol.
· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
