RELATING TO EMPLOYMENT PRACTICES. Makes it an unlawful practice for any employer or labor organization to bar or discharge from employment, withhold pay from, or demote an employee because the employee legitimately uses accrued and available sick leave. Limited to employers with one hundred or more employees that is covered by a collective bargaining agreement. Exempts cases where an employee is unable to fulfill essential job functions or abuses the use of sick leave. Effective 7/1/2050. (SD1)

RELATING TO UNEMPLOYMENT INSURANCE BENEFITS. Repeals the June 30, 2012 sunset date of provisions related to partial unemployment benefits. Removes the eight-week limitation on partial unemployment benefit status. Makes mandatory, rather than discretionary, the waiver of registration and work search requirements for individuals who are partially employed. Authorizes an individual that is attached to a regular employer that is not offering work to continue to be eligible to receive unemployment insurance benefits even if that individual voluntarily or involuntarily separates from part-time employment, with or without good cause from a secondary employer during that week. Effective 7/1/2050. (SD1)

RELATING TO PROCUREMENT. Requires the general contractor and applicable subcontractor for construction procurement under the Hawaii public procurement code to file certification of compliance with chapter 103B, HRS, with the notice of final completion of the contract. Provides that the general contractor shall not be sanctioned for noncompliance by a subcontractor. Allows general contractor to withdraw a bid prior to award of a contract if it finds it is unable to comply with eighty per cent Hawaii workforce requirement. Effective 07/01/2050. (SD2)

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/emailtestimony.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
