RELATING TO VOTING. Requires an application to register to vote in person or by mail-in to include a request for permanent absentee ballot. Removes time limit on requesting an absentee or permanent absentee ballot but not later than 4:30 p.m. on the seventh day prior to the election.

RELATING TO TAXATION. Establishes conditions to inspect required records and receipts of cash business transaction and permits records to be prepared by hand or by cash register. Clarifies state of mind for violation of record and receipt requirements. Limits fine for violation if person is otherwise in compliance with tax laws.

RELATING TO TAXATION. Establishes a one-time amnesty program for delinquent income tax obligations, provides equitable relief in certain tax situations, and places the burden of proof on the department of taxation in certain circumstances.

RELATING TO REAL PROPERTY TAX APPEALS. Requires real property tax appellants to first obtain a decision from an administrative body established by county ordinance prior to appealing to the Tax Appeal Court.

RELATING TO TRAFFIC FINES AND FEES. Raises certain fines and fine ceilings for traffic offenses. Increases administrative fees for certain traffic offenses and allocates a portion of those moneys to the judiciary computer system special fund, judiciary facilities repair and maintenance special fund, and the general fund.

RELATING TO CHAPTER 480, HAWAII REVISED STATUTES. entities to bring an action for damages notwithstanding their status as indirect purchasers.

RELATING TO FINGERPRINT RETENTION BY HAWAII CRIMINAL JUSTICE DATA CENTER. Allows the State to retain fingerprints of employment and licensing applicants for whom criminal history record checks are authorized statutorily so that the State can implement a statewide "Rapback" program.

RELATING TO THE DEPARTMENT OF THE ATTORNEY GENERAL. Amend sections 28-16 and 661-22, Hawaii Revised Statutes, to enable the Attorney General to retain and deposit thirty-three percent of any recovery from any civil action or settlement of a civil claim initiated or prosecuted by the Attorney General to be used for staffing, expenses, equipment and training.

RELATING TO THE PROBATION SERVICES FEE. Imposes a probation services fee on any defendant granted a deferred acceptance of guilty or no contest plea.

RELATING TO DISTRICT COURTS. Clarifies the circumstances under which a district court may serve a summons or other writ outside of the State.

RELATING TO CHILD SUPPORT ENFORCEMENT. Includes tribal IV-D agencies and foreign countries as defined under federal regulations as authorized agencies that services and information can be provided to and received from.

RELATING TO THE HAWAII UNIFORM COLLABORATIVE LAW ACT. Enacts Uniform Collaborative Law Act, which authorizes disputants to enter into collaborative law participation agreements signifying interest to resolve the dispute without intervention of a tribunal (court or other third party decision maker). Requires parties to a collaborative law process to disclose information fully, candidly, and informally without formal discovery. Subject to certain exceptions, disqualifies attorneys in the collaborative process (and their law firms) from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:

EMAIL: For comments less than 5 pages in length, transmit to JUDtestimony@capitol.hawaii.gov ; or
WEB: For comments less than 4MB in size, transmit from the Web page at http://www.capitol.hawaii.gov/emailtestimony.
Testimony submitted will be placed on the Legislative Web site after the hearing adjourns. This public posting of testimony on the Web site should be considered when including personal information in your testimony.
