RELATING TO DOGS. Establishes requirements for licensure and regulation of large-scale dog breeders. Effective 7/1/2012. (SD1)

RELATING TO PROCUREMENT. Requires the general contractor and applicable subcontractor for construction procurement under the Hawaii public procurement code to file certification of compliance with chapter 103B, HRS, with the notice of final completion of the contract. Provides that the general contractor shall not be sanctioned for noncompliance by a subcontractor. Allows general contractor to withdraw a bid prior to award of a contract if it finds it is unable to comply with eighty per cent Hawaii workforce requirement. (SD1)

RELATING TO ETHICS. PROPOSED SD1: Establishes prohibitions and exceptions regarding gifts to legislators and emplyees.

RELATING TO EMPLOYMENT RELATIONS. Prohibits employers from discriminating against an employee or applicant for employment based upon the employee's or the applicant's domestic abuse victim status; provided that the domestic abuse victim notifies the employer of such status.

RELATING TO THE HAWAII PREPAID HEALTH CARE ACT. Repeals the sunset provision of the Hawaii Prepaid Health Care Act. Repeals Act 99, Session Laws of Hawaii 1994, which repealed the sunset provision of the Hawaii Prepaid Health Care Act effective upon certain federal law.

RELATING TO CHANGING REFERENCES IN THE HAWAII REVISED STATUTES FROM "MENTAL RETARDATION" TO "INTELLECTUAL DISABILITY". Changes references in the Hawaii Revised Statutes by substituting "intellectual disabilities", or like term, wherever the term "mental retardation", or like term, appears.

RELATING TO CHILD PROTECTIVE ACT COURT PROCEEDINGS. Ensures that child protective act hearings in chapter 587A, Hawaii Revised Statutes, are consistent with federal Title IV-E provisions. (SD1)

RELATING TO THE COURTS PROPOSED SD1: Permits a court to allow a petition, complaint, motion, or other document to be filed identifying the parties as "jane doe" or "john doe; permits a court to use a multi-factor balancing test when determining if an anonymous filing is appropriate. Permits a court to allow an alleged victim to be listed as "jane doe" or "john doe" within court filings when petitioning for a temporary restraining order and an injunction from further harassment; provided that the court determines it would be necessary to protect the privacy of the petitioner. Also permits courts to seal court records associated with the "jane doe" or "john doe" filing under certain circumstances.

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS. Extends the sunset date of Act 87, Session Laws of Hawaii, from July 1, 2011 to July 1, 2015; Act 87 excepts from the environmental impact statement law, certain primary actions not subject to discretionary consent and involving ancillary secondary actions limited to infrastructure in public rights-of-way or exempt highways.

RELATING TO ASSET FORFEITURE. Requires the forfeiture of any equipment, article, instrument, aircraft, vehicle, vessel, business record, or natural resource used or taken in violation of the laws or rules applicable to the Kaho‘olawe Island Reserve.

RELATING TO AQUATIC LIFE. Establishes two new marine life conservation districts on the island of Maui. Requires the division of aquatic resources of the department of land and natural resources to report to the legislature on the effectiveness and enforcement of the conservation district designation. Effective 1/1/2012. (SD1)

When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.
Please note: If you submit your written testimony after 10:00 a.m. the day prior to the hearing, please sign-in at the staff table to testify orally. A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing.
