RELATING TO THE JUDICIARY.

Establishes the access to justice trust fund under the judiciary as an endowment, to be administered by a nonprofit entity.  Requires investment of the principal.  Authorizes disbursement of interest earned to fund nonprofit legal service organizations to assist with the legal services needs of the poor, indigent, and other vulnerable populations.

Creates a citizen's family law advisory committee to be placed, for administrative purposes, in the judiciary.

Establishes a program in the family court for the registration of child custody evaluators; allows board of family court judges to adopt certification of child custody evaluators.

Prohibits discovery and limits the award of costs in controversies involving small claim tax appeals.

Provides that attorney's liens shall attach to judgments, decrees, orders, settlements, and awards pursuant to a court order or arbitration proceeding.

SB 1457

RELATING TO SUMMARY ADMINISTRATION OF SMALL ESTATES.

Authorizes the successor to a small estate to close the estate through a petition process, rather than requiring the successor to close the estate through probate.  Allows the successor to obtain a court order covering both personal and real property.  Applies to small estates worth $100,000 or less, where forty or more days have elapsed since the decedent passed away.

RELATING TO FINES.

Provides for threefold damages of any pecuniary gain derived from an offense against the State when the defendant is an employee of the State.

·         In person:  1 copy of their testimony to the committee clerk, Room 002, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 10:00 a.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing. 

 

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
